Toledo business owner sues over chemical release

A Toledo business owner has filed a class-action lawsuit against the facility where a chemical release happened, along with the facility’s parent company and plant manager, according to Lucas County Common Pleas court documents. Todd Hartford, owner of Hartford's Fencing & Landscaping LLC in Toledo, has filed a class-action lawsuit against M.C. Tank Transport, Kenan Advantage Group, Inc. and plant manager Albert Dudek. The lawsuit alleges negligence, gross negligence/recklessness, nuisance, and strict liability for an abnormally dangerous activity. The release of glycidyl methacrylate, a chemical used in resins, coatings and adhesives, occurred on Oct. 20 and led to the evacuation of all residents within one mile of MC Tank and a three-mile shelter-in-place order. Hartford argues that GMA can cause cancer and other serious health problems. He is seeking class-Action status for residents displaced and businesses forced to close due to the release.
